1. HOW TO USE THE WEB PAGE The web page is limited to private use and commercial usage will not be tolerated. The user is not entitled to make copies of the page nor parts thereof. The presentation, publishing, exposition, alteration or fabrication of a web page based on this page or part of it are forbidden without the express permission of Open House Spain S.L. The right to use the web page to obtain information or to make a booking is conceded only to persons over the age of 18; individuals; legal persons; or to representatives of institutions or companies. We reserve the right to change the web page, parts thereof and its content as and when is deemed necessary. Although every effort is made to ensure the accuracy of the information displayed on the web page, it contains informative material which is reliant upon third persons and/or institutions. For this reason, we do not claim responsibility for the said information.
2. BOOKINGS Upon requesting a booking the user agrees to enter into a contract according to the conditions of use set forth and from this moment will be referred to as client. Once booking confirmation is sent by Open House Spain S.L. via Electronic mail, fax or by post a valid contract will be finalised. We reserve the right to amend any errors owing to mistakes in calculations or orthography. The client is fully answerable to all of the obligations set forth within the contract and is responsible for all people accompanying them and whom are included within the reservation.
3. TARIFFS AND PRICES All of the tariffs are quoted in Euros (€). Changes in the exchange rates of currency are updated regularly. Although unlikely, it may nevertheless occur that prices vary very slightly.
4. REQUEST OF SERVICES Upon making a booking the user authorises Open House Spain S.L. to charge their credit card (or other approved means of payment) for each and every purchase of service, requested by the user within the page.
5. CREDIT CARDS AND SECURITY Open House Spain S.L. takes every possible precaution to protect information relating to users on our web page. The personal data of users will be protected on-line as well as in our offices. Upon the client entering personal data (such as credit card numbers) onto our forms, this information is coded and protected by the best software on the market - SSL and PGP. A secure page, such as our forms for reserving accommodation or courses, bears a closed lock within the navigator, such as Netscape or Microsoft Internet Explorer, whilst on other pages which are simply being navigated the lock appears open. At the same time as using SSL software to protect personal data on-line and PGP to protect this during the transmission of data, we also do everything within our power to protect the user offline.
6. BOOKING CONFIRMATIONS Confirmation of booking is received on screen, and by email, after the reservation having been sent. Mails may arrive to your Spam folder, and therefore it is necessary to check all of your e-mail folders in any eventuality. Availability for places on courses in Spain will need to be confirmed by the school, particularly during high season. In the case of not being able to proceed with your booking request all of your personal data, as well as your credit card information, will be immediately deleted. Any possible bank transfers and credit card payments will be refunded.
7. CANCELLATION AND ALTERATION POLICY The cancellation policy is dependant upon the time when said cancellation is communicated and must be carried out via Electronic Mail, fax or the on-line contact form. CANCELLATIONS WILL NOT BE ACCEPTED BY TELEPHONE. Our opening hours can be viewed on the contact section within the Web page. In the case of receiving a notification of cancellation in form of one of the aforementioned methods outside of these hours (local Barcelona time), the previous working day will be considered as the date of reception.
ACCOMMODATION (EXCEPT HOTELS) The cancellation policy applies to ALL CHARGES PAID BY THE CLIENT UP TO THE DATE OF RECEPTION OF CANCELLATION, in other words: prepayments, deposits and advance payments, both total and partial, and both to Open House Spain and to the proprietor. The Cancellation Policy: * Cancellations made more than 45 days before arrival: a cancellation fee of 100% of the deposit made to confirm the reservation will be charged. * Cancellations made 45 days before arrival or less: a cancellation fee of 100% of the total of all payments made up until the date of cancellation will be charged. * Cancellations made 2 days or less before arrival and/or in case of no show at the apartment without prior warning: a cancellation fee of 100% of the total of all payments made will be charged. In the case of having paid only the prepayment, an additional fee of 50% of the total the remaining balance will be charged. That amount will be charged in the same way as all previous payments made. This cancellation policy will apply on a general basis, except when in the description of the property reserved a different policy is shown, in which case this would take presedence over the general one. It is recommended, for the above reasons, that you obtain travel insurance which covers you in case of cancellation.
Alteration policy: This policy applies to alterations on bookings for ACCOMMODATION: APPARTMENTS, HOUSES, SHARED FLATS, GUEST HOUSES AND ROOM RENTALS, and by alterations it being understood: changes in the date of services rendered beginning or terminating, number of persons, the contracted product, the destination or a change in property. * 1st Alteration to a booking: €0 administration charge * 2nd Alteration and/or successive alterations to a booking: €20 + 16% VAT in administration/alteration charges. In the case that Open House Spain does not receive the corresponding payment for administration charges prior to the date of commencement of services from the client (applicable to the 2nd Alteration and/or those subsequent), and/or cancellation charges derived from a change in booking, this omission will authorise Open House Spain S.L. to cancel, unilaterally and in totality the said reservation for failure to comply with the Terms and Conditions accepted by the client.
Changes involving a reduction in service:
* 45 days before arrival or less: changes involving a service reduction will not be accepted
* More than 45 days before arrival: a fee of 100% of the prepayment made to confirm the reservation will be charged.
* For an apartment change, it will be necessary to cancel the original booking and make a new one. A discount of 10% will be applied to the new reservation.

The policy applicable to cancellation varies according to the hotel. Due to this, conditions of cancellation are established for each booking after having consulted availability and prices. These conditions will be included in your booking confirmation. Modifying a hotel booking: Hotel bookings can be modified by fax, email or telephone. In addition to the charges stipulated below, in some cases, it may be necessary to pay additional charges. * 1st Alteration to a booking: €0 administration charge * 2nd Alteration and/or successive alterations to a booking: €20 + 7% VAT in administration/alteration charges. It is recommended, for the above reasons, that you obtain travel insurance which covers you in case of cancellation.
8. FORCE MAJEURE The client is not freed of the obligation of payment due to personal circumstances or force majeure such as war, strikes or natural catastrophes.
9. ARRIVAL/DEPARTURE
ACCOMMODATION (EXCEPT HOTELS) Upon your confirmation the place for the handing-over of keys will be indicated, which as a general rule is the same as the address of the accommodation. The client, in any case, must always get in contact with the contact person before their stay to agree a meeting time and place. As a general rule, this contact person will show the client around the accommodation, bringing the keys and also being present upon the day of departure. The arrival time needs to be agreed with the contact person, and is usually between 4 p.m. and 8 p.m. In case of delay, the client should inform the contact person immediately. Departure from the accommodation must be before 11 a.m. In the case of being delayed in arriving to the accommodation, or in the case of an early departure, there will be no discount upon the total price of the booking. Upon arrival at the accommodation, the client will need to hand over the booking confirmation, as well as a copy of their identification, to the contact person for registration. This is required by law. The contact person has the right to refuse people who aren't in possession of identity documentation. It is not permitted for the accommodation to be occupied by people other than those mentioned in the booking forms or those who are with you upon arrival. Changes to people during your stay is strictly prohibited. In addition, it is not permitted for the accommodation to be occupied by more people than mentioned in the booking confirmation. In such cases, the proprietor has the right to tell you to leave the accommodation immediately.
HOTELS Arrival times at the hotel may vary according to the establishment. These can be enquired about directly at the selected hotel by calling the number indicated on your confirmation. If you are expecting to arrive late, we would ask you to duly inform the hotel by contacting them directly.
10. SECURITY DEPOSIT (NOT APPLICABLE TO HOTELS) This deposit is paid as a guarantee to ensure that no damage is done within the accommodation. Open House Spain S.L. neither collects nor hands back the security deposit. The security deposit (which is indicated during reservation) must be handed to the contact person at the accommodation and it will be given back by the same person. Open House Spain S.L. is not involved in dealing with the deposit. Under no circumstances do we take responsibility for the loss of a security deposit, nor for disputes which may arise from the handing back of security deposits. The contact person has the right to refuse to hand over the keys to clients should they fail to pay the deposit indicated upon the booking confirmation. Upon the day of departure, the contact person will hand back the deposit (excepting where possible damage has taken place) only after having carried out an inspection of the accommodation.
11. BEFORE AND DURING YOUR STAY OPEN HOUSE SPAIN, S.L. does not, under any circumstances, accept responsibility for any possible damage or loss which might result from your trip, within the accommodation, during your stay, or during inbound and outbound travel.
12. DESCRIPTION OF ACCOMMODATION All of the information regarding accommodation, including photos and prices are provided by the proprietor/hotel to Open House Spain S.L. and we do everything possible to ensure that this information is correct and to keep it updated. Nevertheless, Open House Spain S.L. does not take responsibility for the content in the descriptions of accommodation.
13. PRIVACY POLICY Open House Spain S.L. wishes to demonstrate its determination in protecting your privacy. If you wish to find out more about the gathering and use of personal data, from whom and how it is obtained and with whom it will be shared, please consult our privacy policy.
14. COMPLAINTS- ACCOMMODATION (EXCEPT HOTELS) In the case of complaints about your accommodation, it would be necessary to address these IMMEDIATELY to the contact person. Should you fail to do this, you will lose all rights to claim compensation. If the reasons for your complaint have not been dealt with within an appropriate period of time, this should be communicated to Open House Spain S.L. Any claim for compensation must be presented in written form within the period of one month. Claims sent after this will not be dealt with. Under no circumstances will Open House Spain S.L. be held responsible for possible cuts in the water, light or gas supply as a consequence of exceptional circumstances and emergencies established by the competent governmental body (for example the Department for the Environment).
HOTELS In the case of complaints regarding your accommodation, it would be necessary to address these in written form, using for example the complaint form from the establishment (in the eventuality of subsequent reclamation asking for a copy signed by the hotel) directly to reception or to the manager of the hotel, in order to allow them to undertake the correct procedures to resolve the situation. Open House Spain, S.L. cannot be held responsible for any possible loss or damage resulting from the acts, omissions or negligence on behalf of third parties or providers. In the case that the hotel or accommodation does not take the necessary steps to deal with the reasons for your complaint within an acceptable period of time, you should get in contact with us during your stay in order to be able to arrange a suitable alternative, as demonstration of our good-will, within the constraints of what is possible and limiting ourselves to the amount paid for your reservation. A claim for compensation would not be considered after departure, as the complaint would not have been processed during your stay.
15. RESPONSIBILITY Open House Spain S.L. acts as agent on behalf of private accommodation and of hotels. As such, Open House Spain S.L. can never be held responsible for delays, accidents, losses, changes to itinerary or tariffs, damage and injury, etc (to both persons and objects), which could occur during one of the contracted services. Open House Spain S.L. and its employees will never be held responsible for personal harm or injury incurred in any of the accommodations on this web page during the length of stay contracted by means of Open House Spain S.L., and contained within links to other pages found upon this web page. The service provided by Open House Spain S.L. concludes with the preparation and emission of booking documentation. The responsibility of Open House Spain is, in every case, limited to the total quantity of the contracted services.
16. WAIVER OF CONTRACT BY OPEN HOUSE SPAIN S.L. Open House Spain S.L. and the proprietor of the contracted accommodation may terminate the contract without repercussion, if, independently of warnings from Open House Spain S.L., the client causes continual disturbances during their stay or behave in a manner contrary to the conditions of the agreement to an extent which renders the immediate termination of the contract justifiable. Should this situation arise for the motives specified above, our demand for the total sum of the stay will still be enforced.
17. CLAUSES In the case of one of the paragraphs within this agreement being declared illegal by a tribunal, this would not affect the validity of other paragraphs. An exclusive area of jurisdiction is approved for lawsuits against Open House Spain S.L. Barcelona.
18. REGISTER Open House Spain S.L. and other graphics, logos and names appearing within this web page are registered trademarks of Open House Spain S.L. or of its respective providers. These registered trademarks may not be utilised, for any product or service which is not offered by Open House Spain S.L. or its respective providers, and/or in any way which could cause confusion among its clients, and/or in any way which devalues or discredits the company Open House Spain S.L.
